These Terms & Conditions (“Terms,” “Agreement”) govern your access to and use of Selling System’s websites, software, CRM platform, AI tools, communities, courses, coaching programs, and all related services (“Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS
By using the Services, you acknowledge that you:
- Have read, understood, and agree to these Terms
- Are at least 18 years old
- Have the legal authority to enter this agreement
- Accept full responsibility for your decisions, actions, and outcomes
2. NO FINANCIAL OR MONETARY GUARANTEES
Selling System does not make any guarantees regarding:
- Revenue
- Profit
- Financial outcomes
- Business success
- Lead volume
- Sales performance
- Cost savings
Any examples, testimonials, case studies, or results shown on our website, emails, webinars, or marketing materials are illustrative only and not typical.
Your results depend on many factors, including:
- Your skills and experience
- Your business model
- Your effort and consistency
- Your market conditions
- Your adherence to the program
You acknowledge and agree that you are solely responsible for your business results.
3. RISK ACKNOWLEDGMENT
By using our Services, you agree that:
- Entrepreneurship involves risk
- Marketing involves risk
- Paid advertising involves risk
- Results can vary dramatically
- You may lose money, time, or resources
You use the Services at your own risk.
Selling System (Frost The Brand LLC) is not liable for:
- Loss of revenue
- Loss of business
- Loss of profits
- Failed campaigns
- Client issues
- Platform downtime
- Incorrect implementation
4. PROGRAM GUARANTEE (ACTION-BASED)
Some Selling System programs include a guarantee. The official guarantee for Selling System Air (and any other offer with a guarantee) is:
30-Day Action-Based Guarantee
You may request a refund if:
- You complete the core training material
- You launch at least one ad campaign using our framework
- You take at least five real sales calls generated from your marketing efforts
- You request the refund within the specified timeframe
If you meet all the conditions and still do not feel the program delivered value, we will issue a refund.
Guarantees do not apply if you:
- Do not complete the required actions
- Purchase and do nothing
- Abuse refund loopholes
- Fail to provide proof of implementation
For higher-ticket programs, the guarantee may differ and will be specified separately.
5. NO PROFESSIONAL ADVICE
The Services do not constitute:
- Financial advice
- Legal advice
- Tax advice
- Investment advice
- Medical advice
- Professional consulting advice
All information is for educational purposes only.
You agree to seek professional advice from a qualified advisor before making decisions.
6. USER RESPONSIBILITIES
You agree that you will:
- Provide accurate, up-to-date information
- Maintain confidentiality of your login credentials
- Comply with all applicable laws when using the Services
- Use the platform ethically and without exploitation
- Not share, resell, or distribute course material without permission
You also agree not to:
- Reverse engineer, copy, or clone our content or software
- Violate any platform’s advertising policies (Meta, Google, TikTok, etc.)
- Upload harmful code, bots, or unauthorized automations
- Use the Services for illegal, misleading, or unethical practices
7. INTELLECTUAL PROPERTY
All intellectual property, including:

- Sales scripts
- Training videos
- Templates
- AI tools
- Automations
- Course material
- Branding

Users receive a revocable, non-exclusive, non-transferable license to access and use the materials for personal business use only.
You may not reproduce, repackage, or resell any part of the material.
8. USER-GENERATED CONTENT LICENSE
By submitting content (messages, uploads, testimonials, videos, audio, screenshots, etc.), you grant Selling System (Frost The Brand LLC) an:
Irrevocable, perpetual, worldwide, royalty-free, transferable, sublicensable license to:
- Store
- Reproduce
- Publish
- Modify
- Distribute
- Use in advertising
- Use in marketing
- Train AI models
- Create derivative works
- Display publicly
You waive all rights to approval, royalties, or future compensation.
9. PAYMENT TERMS
You agree that:
- All purchases are final unless covered by a written guarantee
- Failed or overdue payments may result in account suspension
- Chargebacks are a violation of these Terms
- Chargebacks will result in immediate removal from the program
- Past-due balances may be sent to collections
For subscription plans:
- Billing recurs automatically
- You may cancel future payments at any time
- Canceling does not grant access to refunds for past payments unless eligible by guarantee
10. SMS, EMAIL & CALL CONSENT
By providing your contact information, you consent to receiving:
- Emails
- SMS/text messages
- Phone calls
- AI-based or automated calls
- Marketing communications
- Transactional communications
- Account notifications
You may opt out of SMS at any time by replying STOP.
11. DISCLAIMERS
To the maximum extent permitted by law:
- The Services are provided “as is” and “as available.”
- We make no warranties of any kind, express or implied.
- We do not guarantee results, income, success, or financial outcomes.
- We are not responsible for third-party actions or platform changes.
- You assume all risk associated with using the Services.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Frost The Brand LLC is not liable for:
- Indirect, incidental, special, punitive, or consequential damages
- Loss of profits or business
- Loss of data
- Business interruption
- Errors in implementation or user mistakes
- Platform downtime or outages
Maximum liability is limited to the amount paid by you in the past 30 days.
13. TERMINATION
We may suspend or terminate your access if you:
- Violate these Terms
- Abuse support or staff
- Engage in fraud or unethical behavior
- Disrupt the community or Services
- Fail to pay any required fees
Upon termination:
- Access to all materials is revoked
- No refunds are issued unless required by written guarantee
14. GOVERNING LAW
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
Any disputes shall be resolved exclusively through:
- Binding arbitration in Arizona, or
- Another mutually agreed-upon location
Class action waivers apply.
15. CHANGES TO THESE TERMS
We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the new Terms.
